Smithston Fishings Club agree to give permission for nominated anglers to fish on the Smithston Water for a specified period. This will be confirmed by us, on receipt of the agreed fee, in the form of an invoice acknowledgment.
IMPORTANT: when you book with The Smithston Fishings Club, you are agreeing to abide by our Terms and Conditions in full.
Visitors are required to carry the Invoice Acknowledgment whilst on the Smithston Water and be prepared to show it on request, to any Member, Bailiff, or River Keeper.
It is the responsibility of the person or persons booking with us to ensure that all members of their fishing party are aware of and agree with our Terms and Conditions and, our Club Rules and Bylaws, with no exceptions.
All bookings and inquiries are handled by The Factor. Please under no circumstances email or phone members of the Club or Management Committee directly.
We reserve the right to refuse bookings at the Club’s discretion.
No representatives of The Smithston Fishings Club will be held responsible for our guest’s behaviour or their safety during their time with us, on or off the river.
All guests are expected to maintain a reasonable standard of behaviour throughout their time on the river and on adjoining land.
We reserve the right to rescind any visitor’s permission to fish – with immediate effect – if their behaviour is, in our opinion, or in the opinion of others, likely to cause distress, damage, danger or annoyance to other people or to property. In this event The Smithston Fishings Club shall be under no liability to refund, compensate or pay any cost incurred by any guest whose permission to fish is so terminated.
Very occasionally it may be necessary, due to unforeseen circumstances or events beyond our control to change some detail of the fishing arrangements, in this event Smithston Fishings Club will try to maintain the high standards of timeliness, elegance and customer care.
If you are unhappy with any aspect of your time with the Club, please notify The Factor () as soon as possible, so that we have the opportunity to resolve the problem.
When fishing, visitors are advised to wear buoyancy aids. Any decision not to wear aids, remains an individual responsibility.
We recommend that seat belts are to be worn at all times when traveling in the cars close by the river.
Force majeure: Smithston fishings Club will not be liable for any loss or delay occasioned by any of the following: Strikes, Riots, Political Unrest, Hostilities, War or Threat of War, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical/Weather problems to transport, Closure of Ports, Weather Conditions or any other event(s) beyond our control.
It is essential you organise your own travel insurance to cover any travel or accomodation booking in the event of travel restrictions, ferry cancelations, flight cancellations, injury, sickness, accident or death. This is your own business and Smithston Fishings Clubs accepts no responsibility for this.
Any photos of fish caught on Smithston Fishings Club water may be used by us for promotional or social media purposes.
At the discretion of The Factor, refunds may be given in the event of an emergency.
In the event of a non-emergency cancellation, more than 7 days ahead of the Visitor Ticket (with an opportunity to resell/reallocate) a full refund may be given on confirmation of a resale.
In the event of a non-emergency cancellation, less than 7 days ahead of the Visitor Ticket (with limited opportunity to resell), the ticket price will automatically forfeit.
These terms and conditions are subject to Scottish Law and the exclusive jurisdiction of the Scottish Courts.
